Overview

These Terms of Use (“Terms”) govern your access to and use of the Pacific Spruce Federal Credit Union mobile application, website, and related financial products, member services, and digital features (collectively, the “Services”), operated by Pacific Spruce Federal Credit Union (“we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

The Services provide access to credit union membership features, financial tools, account-related services, and informational resources. Pacific Spruce Federal Credit Union may also facilitate access to certain financial products or third-party service providers where applicable. We do not guarantee approval for any financial product, and all decisions, terms, and contractual obligations remain subject to applicable underwriting, eligibility requirements, and third-party terms where relevant.

Eligibility

To use the Services, you must:

• Be at least 18 years old (or the age of majority in your state)
• Be a lawful resident of the United States
• Have the legal capacity to enter into binding agreements
• Provide accurate, complete, and up-to-date information
• Use the Services only for personal, lawful purposes

You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized access.

Financial Services, Terms & Repayment

• Account activity and relationship with the credit union
• Applicable underwriting criteria
• Federal and state regulations

All applicable rates, fees, and total obligations will be clearly disclosed before you agree to any financial product or service.

3.2 Repayment Terms

Repayment obligations vary depending on the financial product or service. Where applicable, you will receive a clear repayment schedule showing:

• Total number of payments
• Amount of each payment
• Due dates for all payments

3.3 Payment Methods

Payments may be processed via electronic transfers (ACH debit), internal account transfers, or other approved methods. You are responsible for ensuring sufficient funds are available to avoid fees or penalties.

3.4 Fees & Charges

Any applicable fees—including service fees, late fees, returned-payment fees, or other charges—will be disclosed prior to your acceptance of the applicable service or agreement. There are no undisclosed or hidden fees imposed by the credit union.

3.5 Early Payoff

Certain financial obligations may be eligible for early repayment without penalty, depending on the specific agreement. You should review all applicable disclosures and agreements for details.

Account Responsibilities

You must provide accurate information and maintain it throughout your use of the Services. You may not:

• Submit false, misleading, or incomplete information
• Share your account credentials
• Access another person’s account
• Engage in prohibited or fraudulent activities

We may suspend or terminate accounts suspected of violating these Terms.

Electronic Communications

By using the Services, you consent to receive electronic communications, including:

• Email notifications
• SMS or text messages
• In-app alerts
• Digital agreements and disclosures

These communications have the same legal effect as paper documents. Certain notices may be legally required and cannot be opted out of.

Data Accuracy & Authorization

By submitting information, you authorize Pacific Spruce Federal Credit Union to:

• Collect and process your personal and financial data
• Use service providers to support account functionality and operations
• Verify your identity, financial information, and account details using third-party verification services

Providing inaccurate, incomplete, or misleading information may result in denial of services, account suspension, or legal consequences.

Fees & Compensation

Access to certain Services may be provided without direct fees; however, fees may apply to specific financial products or account services as disclosed. Pacific Spruce Federal Credit Union may engage with service providers or partners in connection with certain offerings, consistent with applicable laws and regulations. Any such arrangements do not alter your obligations under applicable agreements.

Permitted & Prohibited Use

You agree to use the Services lawfully. Prohibited activities include:

• Violating laws or regulations
• Attempting unauthorized access to systems, accounts, or data
• Using automated tools or scripts to extract data
• Uploading malware or harmful software
• Copying, reverse-engineering, or distributing the Services
• Sending unsolicited communications or spam

Violation may result in account termination and legal action.

Service Changes

We may modify, suspend, or remove Services features without notice. Maintenance or updates may temporarily affect availability. Pacific Spruce Federal Credit Union is not liable for interruptions or modifications.

Intellectual Property

All content—including text, graphics, logos, software, and data—is owned by Pacific Spruce Federal Credit Union or its licensors. Users are granted a limited, non-exclusive license for personal, non-commercial use. Unauthorized reproduction, distribution, or commercial use is prohibited.

Disclaimers

The Services and all content are provided “as is” and “as available.” Pacific Spruce Federal Credit Union does not guarantee accuracy, completeness, or uninterrupted access. All express or implied warranties, including merchantability, fitness for a particular purpose, or non-infringement, are disclaimed. Use of the Services is at your own risk.

Limitation of Liability

To the fullest extent permitted by law, Pacific Spruce Federal Credit Union is not liable for:

• Indirect, incidental, special, or consequential damages
• Loss of data, profits, or other intangible losses

Total liability is limited to $100 per user, unless otherwise required by law. Some state laws may not allow such limitations.

Indemnification

You agree to indemnify and hold harmless Pacific Spruce Federal Credit Union, its officers, employees, and partners from claims, losses, or expenses arising from:

• Your use or misuse of the Services
• Violations of these Terms
• Breaches of applicable law or third-party rights

Governing Law & Disputes

These Terms are governed by the laws of the State of Oregon. Disputes will be resolved through individual arbitration under the Federal Arbitration Act. Class actions are not permitted. If arbitration is unavailable, disputes will be resolved in applicable state or federal courts located in Oregon.

Termination

We may suspend or terminate your access for violations, suspected fraud, or harmful behavior. You may discontinue use at any time. Provisions regarding liability, indemnification, and dispute resolution survive termination.
